Davis-Bacon and Related Acts (DBRA) labor compliance requirements for federally funded projects under the Davis Bacon Act Title 29 CFR 5.5 as determined by the United States Secretary of Labor (also referred to as "Wage Decisions").

Since 2014 Tailbay has provided professional consultant services to both Federal & State Agencies, Municipalities, Non-profits, Public Housing Agencies, and Private Community Housing Development Organizations (CHDO) with accurate Wage Determinations and monitoring for projects receiving federal and/or state funding.

Our DBRA Services:
• Identify local prevailing wage determination issuance's for affected trades in identified development projects

• Conduct on-site interviews with employees of subcontractors and/or sub-recipients and maintain a record thereof.

• Ensure that the appropriate local prevailing wage decisions, as issued by USDOL, are included in project contract specifications.

• Ensure fringe benefits are appropriate and eligible, where appropriate request details.
• Ensure the posting, of the wage determination(s) and Department of Labor Publication: WH-1321, Notice to Employees Working on Federal or Federally Assisted Construction Projects, are posted at all project sites.
• Examine payroll data (time cards, tax records, evidence of fringe benefit payment) that supports Weekly Payroll Reports.

• Collection of "No Work Performed" Certified Payrolls.

• Identification of incomplete reports.

• Review and compare information on interview forms and returned mailed questionnaires to corresponding payrolls to determine consistency with hours and days worked, work classification and rate of pay.
• Review of apprentice or trainee certifications from approved program, where appropriate.
• Review monthly certified payrolls for compliance with the Apprenticeship Act legislation.
• Review the number of apprentices by classification to ensure apprentices are registered with USDOL or State Agency..

A. Davis-Bacon Act (sec. 1-7, 46 Stat. 1949, as amended; Pub. L. 74-403, 40
U.S.C. 276a-276a-7);
B. Copeland Act (40 U.S.C. 276c); and
C. Contract Work Hours and Safety Standards Act (40 U.S.C. 327-332).

 

Federal Regulations:
U.S. Department of Labor (29 CFR Parts 1, 3, 5, 6 and 7).

State Prevailing Wage Rates
